Three Years for Seven: Cleric's Son Walked Free Quietly

A kiai's son left prison after about three years of a seven-year term, quietly, while protected witnesses were not told.

Three years. That is how much prison time stood between a seven-year sentence for sexually abusing a boarding-school student and quiet freedom at a family holiday gathering. Moch Subchi Azal Tsani, widely called Mas Bechi, was supposed to be serving seven years. He was filmed moving freely in the community that produced the case, almost a year after he had left prison, while young women placed under witness protection after testifying against him had never been told he was out 2 9.

The man is not an ordinary teacher. He is the son of Kiai Muhammad Mukhtar Mukthi, caretaker-head of Pondok Pesantren Majma'al Bahrain Shiddiqiyyah in Ploso, Jombang, East Java. At the time of the offences he was himself a teacher and former deputy head inside his father's pesantren. In that closed world, education, residence, worship and obedience centre on the founding family, and spiritual authority shapes jobs, marriages, reputations and access to religious life 2 10.

Seven years imposed, three served

Detention began on 8 July 2022. The Surabaya District Court read the seven-year sentence on 17 November 2022, a verdict later upheld on appeal. English-language BBC wording describes the crime as sexual assault of one female student, a santriwati. Indonesian coverage of the same conviction uses the stronger legal-moral terms pencabulan and pemerkosaan, molestation and rape, and one account says he molested five santriwati and served only about three years. The number of trial victims and the precise legal label do not reconcile across reports 13 33 2.

He left Malang Class I Prison in August 2025 on conditional release, pembebasan bersyarat. One Indonesian business-press account dates the effect to 15 August 2025. Other follow-ups date it to 20 August 2025. The Directorate General of Corrections and the head of Malang Class I Prison, Christo Victor Nixon Toar, confirmed the status, said it was granted in accordance with applicable provisions by decree of the Minister of Immigration and Corrections, and insisted it was not a full or pure release, bukan bebas murni 12 16 8.

In law conditional release still carries supervision. Supervision that victims do not know about cannot reassure. The BBC framing is the inverse of the official routine-release account: a secret early release after serving less than half the term, discovered only because journalists went looking 9 17.

What makes the secrecy allegation concrete is on camera. BBC Eye reporters tracked Bechi down and filmed him undercover attending an Idul Fitri event at his family home in March, establishing that a man the public believed to be serving a seven-year term was moving freely. He was approached with the allegations and did not respond. The pictures became public on 20 and 21 September 2026 3 4.

Former students who testified against him and were placed under witness protection were not informed of his release. For young women who had risked retaliation inside a reverential hierarchy to give evidence, learning from journalism rather than the state that the son of the kiai was free reopens fear in daily life around school events, markets, mosques and family compounds where influence travels fast 9.

A separate allegation now stands beside the conviction. A woman identified as Ira says Bechi raped and sexually abused her over years. That account was put to Bechi without response. Women's rights activists said the release wounded justice, with Ya'qud Ananda Gudban, chair of Komunitas Perempuan Peduli Indonesia, saying the original seven-year verdict was flawed from the start. Minister for Women's Empowerment and Child Protection Arifah Fauzi said the ministry wanted to confirm the reasoning behind the legal-status decision 5 30 33.
