storyTranscript · LOADING0:00A prediction market has thrown out former Congressman George Santos for life.0:04The first lifetime ban in Calchy's history comes with $71,356 in penalties0:10after the exchange concluded he traded on and tried to move, a contract whose0:14outcome was entirely his own, whether he would attend President Trump's State of the0:17Union.0:18The question is whether a market that prices one person's own behavior should ever0:22let that person into the trade at all.0:24Calci's compliance department said it found reasonable cause to believe Santos0:28traded in markets tied to his own attendance, and that after building a large0:32position where the contracts depended on him showing up, he made public statements,0:36some of them false or misleading, to push the price of the yes and no contracts he0:40intended to buy.0:41Santos was barred from that market precisely because he alone could decide its0:45result.0:45That finding is on the record at the exchange itself, and it describes a message0:49campaign, not a market bet.0:51The intent, in Calci's own words, was to move the price of contracts Santos meant to0:56buy.0:56The federal order maps the whole play.0:59Santos opened his account on February 11th with $1,000 and about $6,000 more and1:04made his first Yes trade the next day.1:06By February 22nd, he held roughly 30,800 yes contracts.1:10In the small hours of that morning, he posted on X asking whether to wear a muted1:14suit to the State of the Union or a bedazzled one.1:17Yes jumped from 15 cents to 70.1:19He sold the entire position for $3,400 and pulled 10,000 more into a new1:25Venmo account.1:26That afternoon the airline canceled his flight.1:28He didn't disclose it.1:29And that night he bought a train ticket instead.1:31He told the market the trip was a nightmare and that no way would members fly in.1:35Yes fell from 63 cents to 28.1:38That afternoon he reversed course, posting he'd be there in the gallery haunting1:42them all, and in a video that he was going to be there, Yes climbed back to 701:45cents.1:46At 5.59 he began building a no position near 24,000 contracts.1:50His train was canceled that evening.1:52Again, no post.1:53Asked if he really wasn't going, he said he was.1:56Then on the night of the speech he posted that watching the State of the Union from2:00an airport TV was not part of the plan.2:02Yes, collapsed from 73 cents to 2 cents, and in the early hours of February 25th, he2:07cashed the no side for $14,390, with the yes profit roughly $17,8002:13gross.2:13The federal regulator moved first.2:16On July 31st, the CFTC settled charges under the Commodity Exchange Act, a2:21manipulative or deceptive device, a scheme to defraud, and fraud in the course of2:25business, and ordered Santos to pay $17,570 in disgorgement plus a2:30$17,500 civil penalty, about $35,000, along with a three-year ban from2:36CFTC registered platforms.2:37Kalshi's enforcement director said the exchange flagged the trades investigated and2:42referred them to the CFTC with the evidence needed.2:45Santos signed on without admitting the findings.2:53That is where the accounts collide.2:56Santos had already been expelled from the House in December 2023, sentenced in April3:002025 to more than seven years in federal prison on fraud and identity theft charges,3:06and had that sentence commuted by President Trump roughly four months before the3:10speech.3:10He framed the trip as a gallery stunt, and after his posts, odds on his attendance3:14were quoted around 75% on the eve of the speech.3:17He did not attend.3:18His response is defiant.3:20He thanked the platform for the lifetime ban, asked how much longer it would be3:24around, and called the action frivolous nonsense.3:27He accused Calchie of leaking and grabbing attention and said it violates its own3:32notices and deadlines, citing an August 7th notice he called 30 days.3:36A source told The Hill the actual period was 15 days.3:40That discrepancy is unresolved.3:42His lawyer argued there was absolutely no intent to deceive anyone or manipulate any3:47market, and that the state of the union was the first time Santos had ever bet on a3:52prediction market.3:53Several headlines called it insider trading, that is Calci's theory.3:57Trading on non-public information about his own conduct, plus price-moving4:00misstatements, not a formal finding.4:03The CFTC's settled charges were manipulative and deceptive device, fraud, and a4:07deceitful scheme, accepted without admission.4:09The lifetime ban also sits inside a wave of enforcement.4:12The same week, the CFTC fined a former White House teleprompter operator $172,0004:18for advanced knowledge of speech content.4:20And in that same announcement, Calci temporarily banned and fined political4:24candidates in Maine, California, and North Carolina accused of betting on their own4:27campaigns.4:28They cooperated and got temporary bans.4:31Cooperation buys a lighter sentence.4:33Santos's refusal, in Calci's telling, bought a permanent one.4:36Whether Santos will pay the $71,000 is open.4:40One trader quoted by New York magazine said Calci can't do anything to collect.4:44An opinion, not a court finding.4:46Calci says it froze the account, referred the trades to the CFTC and then to the4:50Justice Department in June, and would use recovered penalties to reimburse the4:54traders on the other side of his positions.4:56No charging decision from the Justice Department had surfaced.4:59What the episode establishes is that a regulated U.S.5:02exchange will now put a trader who controls the outcome out for life and take the5:06same facts to the federal regulator first.5:09What remains untested is whether such a market should ever let its own subject in at5:13all.5:13The contract was listed.5:15The man who was the event opened an account and traded at size, and the alleged5:19manipulation ran for about two weeks before the market resolved.Explore with HeyDexThe shortThe short ↗
