司法 · Coal approvalHigh Court blocks Mount Pleasant coal expansion—but the mine can keep operating播出 2026年10月7日 UTC 23:09本条新闻文字实录 · 正在加载0:09The High Court has blocked Mount Pleasant's planned doubling of coal extraction.0:13The expansion approval envisaged 22 more years of mining and almost 876 million tons0:19of greenhouse gases.0:20But a separate consent lets the operating mine continue into 2032.0:24What would a valid expansion approval now require and how far does this ruling0:28reach?0:28Mount Pleasant is an open-cut coal mine near Muswell Brook in the Upper Hunter0:32Valley.0:33Match Energy Australia owns it.0:35MAC Mount Pleasant Operations is the project applicant and operator.0:38The judgment blocks its larger optimization approval, not every approval governing0:42the mine.0:43The invalid consent would have raised annual extraction from 10.5 million to 210:47million tons of run-of-mine coal.0:49That means coal before processing, not the quantity eventually sold.0:53The Independent Planning Commission conditionally approved the optimization project0:57on 6th September 2022.0:59The optimization consent extended mining to 22 December 2048 at 21 million tons a1:05year.1:05Separate Modification 8 extends mining to 31 December 2032.1:09At 12.5 million tons.1:11The court did not decide that second approval's validity.1:14The blocked extension ran from 22 December 2026 to 2020 December 2048,1:2022 years.1:21Its lifetime coal total and its additional coal amount are different measures, not1:25competing estimates.1:26Approximately 444 million tons of run-of-mine coal were envisaged over the project's1:32life, including an estimated additional 406 million tons beyond the pre-existing1:36consent.1:37The additional amount also appears as 406 million tons.1:41No conversion between those unit wordings is established.1:44The emissions conditions addressed only a small fraction of the projected climate1:47footprint.1:48The decisive legal failure concerned whether practicable conditions should also1:52minimize the much larger emissions associated with supplying the project and using1:56its coal.1:57Scope 3 accounts for 860 million tons of projected carbon dioxide equivalent2:02emissions, approximately 98%.2:05Scope 1 and scope 2 together account for 16.07 million tons.2:10approximately two percent.2:12The combined lifetime projection is 876.07 million tons.2:17Scope 1 covers direct operational emissions.2:19Scope 2 covers purchased energy.2:22Scope 3 includes upstream supply chain emissions and downstream burning of coal,2:26generally in export markets.2:27All 860 million tons cannot accurately be called overseas combustion, and all 16.072:33million tons cannot be called direct on-site emissions.2:36The annual average projections were 0.45 million tons for scope 1, 0.082:42million tons for scope 2, and 33.1 million tons for scope three.2:46These figures describe projected emissions under the proposed project, not gases2:50already released.2:51The Commission imposed conditions focused on scope one and scope two without2:54considering practicable conditions directed at minimizing scope three.2:58That omission, not a finding that climate change was ignored altogether, sustained3:01the approval's invalidity.3:03The planning duty required consideration of conditions to minimize greenhouse gas3:06emissions, specifically including scope three to the greatest extent practicable.3:11It did not require every project to achieve zero emissions, or every coal3:15application to be refused.3:16All five justices found compliance with a different provision, Section 4.15, 1B,3:22concerning likely impacts, including environmental impacts in the locality.3:25Whether climate change could constitute an impact in the locality therefore did not3:29arise for decision.3:31The High Court rejected the Court of Appeals' reasoning on that ground.3:33Three justices sustained invalidity on the emissions conditions ground.3:38Michelle Gordon, James Edelman, and Robert Beach Jones.3:41Chief Justice Stephen Gagler and Justice Jane Jaggo dissented on that point.3:46Their unanimous finding on the locality provision makes the distinction between the3:49two legal grounds essential.3:51On 7 October 2026, the Court dismissed MAC Energy's appeal with costs and granted3:57the Community Group leave to file an amended notice of contention.4:00Mac Energy was trying to overturn the appellate outcome.4:03This was not the High Court allowing a new Community appeal against the Commission.4:07The Community first lost its judicial review before Justice Robson in August 2024.4:12It won in the NSW Court of Appeal on 24 July 2025.4:16The High Court heard MAC Energy's appeal on 13th May 2026 before dismissing it in4:21October.4:22The successful organization is Denman, Aberdeen, Moswellbrook, Scone, Healthy4:26Environment Group, known as Damshag.4:29Its four-year challenge followed the 2022 approval.4:32President Wendy Wales is a retired science teacher who lives adjacent to the mine.4:36Coal's journey overseas does not remove the climate risks for communities at home.4:41The concerns include droughts, bushfires, floods, and extreme heat.4:45Those are risks associated with additional greenhouse emissions, not findings that4:49this mine caused a particular disaster.4:51Other emissions estimates remain unreconciled with the official inventory.4:55Different coal boundaries, greenhouse gas coverage, and methods mean similar-looking4:59totals cannot simply be substituted for one another.5:02A separate tracking inventory uses 322 million tons of coal for 2022 to 2048,5:08with 876 million tons of lifetime emissions.5:11860.16 million tons of scope three and sixteen point zero four million tons labeled5:16direct.5:16Its coal figure is not the Commission's 444 million ton run of mine total.5:20Other descriptions put overseas combustion above 870 million tons of carbon dioxide5:26equivalent, or at 870 million tons of carbon dioxide in a 2024 estimate.5:32Another rendering gives 876.07 million tons overall, all but approximately5:3717 million in scope 3.5:39Their boundaries are not established as equivalent.5:42The specified official inventory remains 860 million tons of scope 3 and5:46876.07 million overall.5:49Modification 8 was approved on 14 August 2026, extending the existing consent to5:5531 December 2032 and raising its annual limit from 10.5 to 12.5 million tons.6:01No order setting it aside has been identified, but the judgment does not separately6:05declare it valid.6:06The company relies on that separate consent for continued operations.6:09The expansion, however, would need a valid planning decision, addressing the defect6:13before proceeding through the invalidated approval pathway.6:15Reconsideration would guarantee neither approval nor refusal.6:18MAC Energy accepts the decision despite its disappointment, intends to review the6:23implications for future assessments and approvals, and is pursuing options for6:26long-term continuity.6:28That NSW government intends to engage closely with the company.6:31Those intentions supply neither a new approval nor a timetable.6:34The ruling establishes a NSW planning duty, not a nationwide cancellation of fossil6:39fuel approvals.6:40Its reasoning carries national authority, but application elsewhere depends on the6:44legislation, the assessment record, and which conditions were considered.6:48Its description as the first High Court climate change case does not make it6:52Australia's first climate case.6:54The Community Legal Team sees national and international significance in the6:58decision and emphasizes limiting emissions from coal burned overseas.7:02Broader claims about a chain from project emissions to local climate harm remain7:06interpretations, not replacements for the court's narrower holding.7:09The coal export ranking invoked in support of the judgment is part of the legal7:13team's public argument, not an independently established trade statistic here, nor7:18does the ruling establish that climate was never mentioned in an earlier High Court7:22proceeding.7:22The industry objections center on meeting global coal demand.7:26Responsibility for export customer emissions and warnings about trade, investment,7:30and sovereign risk.7:31Long approval times, activist litigation, royalties, and taxes are also criticized.7:36These are objections and forecasts, not demonstrated changes to investment or the7:40workforce.7:41Calls for lawyers to challenge other coal approvals do not establish that another7:45project has been stopped.7:46The central issue remains whether an approval authority considered practicable ways7:50to minimize the project's emissions, even when customers rather than the mine7:54release them.7:55A valid renewed assessment would have to address emissions minimizing conditions,7:59including scope 3.8:01Which conditions are lawful and practicable, and whether they would support approval8:05remain unresolved.8:07No dated commission reassessment, court-ordered remittal deadline, or replacement8:10consent has been announced.与 HeyDex 一起探索通过 RSS 关注短视频短视频 ↗
