司法 · 死刑判决赦免纽森寻求撤销加利福尼亚州所有死刑判决，但大多数案件需要法院采取行动文字 2026年11月5日 UTC 21:05观看文字实录0:07Gavin Newsom wants to replace all five hundred forty-eight death sentences in0:11California with life without parole.0:14The prisoners would remain imprisoned, but their death sentences would be0:18permanently replaced, going beyond the existing halt on executions.0:23Can Newsom secure the court recommendations needed for hundreds of these cases0:28before his term ends.0:29Newsom announced his decision on November5,2026 .0:34He's seeking the same punishment for everyone currently condemned.0:38The legal process is still underway, and we don't yet know how many individual0:42commutations have taken effect.0:44Newsom's public decision starts a process that still requires court action for most0:50recipients.0:51His request to the justices covers people convicted of more than one felony.0:56A court recommendation would allow him to grant their clemency.1:00The governor's explanatory statement identifies three hundred and eighty-two people1:05in that group.1:06Matching that figure against the announced total changes, the picture of how much1:11Newsom can do on his own.1:12Newsome needs court recommendations for three hundred and eighty-two people, or1:17sixty-nine point seven percent of the total.1:19The remaining one hundred and sixty-six account for thirty point three percent.1:23That's roughly a seventy-thirty split, correcting the earlier sixty-forty1:28description.1:29Both groups are proposed recipients.1:31California's constitution limits a governor's clemency power when someone has been1:36convicted of two felonies.1:38Those convictions can include crimes before the death sentence or additional crimes1:42committed while awaiting execution.1:44Four of the court's seven justices must agree to recommend clemency in these cases.1:50Newsome would then have to grant each commutation.1:53Once effective, it would replace the death sentence with life imprisonment without1:58the possibility of parole.2:00The recipients would remain convicted and imprisoned for life, with no parole2:04opportunity through this action.2:06Newsom calls that the most severe punishment he can impose through clemency.2:11He argues that the state should refuse to execute people even for brutal crimes.2:16Newsom says, state-sanctioned killing conflicts with California's values.2:21He calls the death penalty system a failure, challenges its fairness, and points to2:27the consequences of mistakes.2:29His decision applies across the current condemned population, without selecting2:34particular prisoners for special leniency.2:36California prosecutors could still seek new death sentences under the law that2:41remains in force.2:43Newsome acknowledges that voters have repeatedly chosen to retain capital2:47punishment.2:48He argues that the same constitution gives governors the power to grant clemency.2:53Voters rejected repeal in2012 , and again in2016.2:58In that second election, they narrowly approved a measure intended to speed death3:03penalty proceedings.3:05Newsom's proposal would change existing sentences, while leaving prosecutors,3:10juries, and courts their roles in future cases.3:13California has carried out thirteen executions since nineteen seventy-eight.3:18The last was Clarence Ray Allen's lethal injection on January17,2006 .3:24He was seventy-six and had spent23 years on death row.3:28His appeals cost the state more than seven hundred and fifty thousand dollars.3:32Newsome halted executions in March2019, withdrew the lethal injection protocol,3:38and closed San Quintin's execution chamber.3:41That pause left death sentences intact.3:44An effective commutation would replace the sentence itself, even though executions3:48are already halted.3:50The chamber was later taken down.3:52All but a handful of the remaining condemned prisoners moved from segregated housing3:57at San Quintin to other facilities.3:59The prison is now called San Quintin Rehabilitation Center.4:03Death row increasingly describes a sentence.4:05Rather than one shared location, capital appeals and petitions challenging4:10imprisonment cost an estimated more than two hundred million dollars a year.4:15Death penalty appeals account for about a quarter of the state supreme court's work.4:20Taxpayers fund defense lawyers, prosecutors, and the courts administering years of4:24litigation.4:25Commutations could reduce capital litigation costs, but nobody has put a reliable4:30savings total on this proposal.4:33Imprisonment would continue, and pending proceedings wouldn't all automatically4:37disappear.4:38Some condemned prisoners are now in their eighties and90 s.4:42After decades under death sentences, potential recipients include Charles Nang,4:47convicted of killing six men, three women, and two infant boys in Northern4:52California in nineteen eighty-four and nineteen eighty-five.4:55They also include Richard Allan Davis, who abducted and murdered twelve-year-old4:59Polly Class of Petaluma in nineteen ninety-three.5:03Christopher Cherry is also covered.5:05He was convicted of murdering, raping, and torturing his girlfriend's three-year-old5:09daughter, Sophia Acosta, in Tulera County.5:12The universal proposal reaches these cases because it covers every current death5:17sentence.5:18Their convictions would remain in place.5:20Bethany Webb's sister Laura was among eight people killed in the2011 Seal Beach mass5:25shooting.5:26Their mother was shot and badly injured.5:28Webb rejects the promise that execution will repair a family's loss and calls the5:33prolonged capital process brutalizing.5:35Sandy Friend sees removal of a death sentence as a betrayal.5:39Her eight-year-old son, Michael Lyons, was abducted and murdered in nineteen5:43ninety-six.5:44She said, It's total disrespect for the victims.5:47It's a slap in the face.5:50Families carry different expectations of what justice should deliver.5:54Newsom acknowledges that his decision will revive painful memories and anger, and5:59hurt some Californians.6:01He calls it among the hardest decisions of his governorship.6:04He says he accepts responsibility for its impact and wants the victims remembered6:09while offenders remain imprisoned for life.6:12A separate constitutional challenge could reach California's death penalty law6:16itself.6:17The state public defender sued in2024 , alleging persistent racial disparities.6:22This spring, the Supreme Court required the Attorney General to explain why capital6:27punishment should survive that challenge.6:29Attorney General Rob Bonta said in August that evidence of pervasive racial6:34disparities could reveal a constitutionally intolerable risk of arbitrary6:38punishment.6:39That lawsuit proceeds separately from Newsom's request for clem court action on the6:43three eighty-two clemency requests is still pending.6:47Newsome's term ends in January2027 .6:51After eight years in office, to complete those commutations himself, he needs the6:55court's recommendations and must issue the final grants while he's still governor.阅读文章事件时间线HeyDex谁报道了什么多家媒体报道的要点✓Newsom’s plan to commute California death sentences已独立证实 · 16 家媒体Supreme Court review of clemency cases10 家媒体✓Sentence terms after commutation已独立证实 ·
