- The driver swerved onto the verge but couldn't avoid hitting thirteen-year-old Caitlin Hogg.
- Her inquest has concluded that the driver had too little time to avoid the collision. Her family wants other children protected on their journey home. What can these findings change for children getting off a school bus?
- Coroner Joe McCrisken delivered the findings at Enniskillen courthouse on Wednesday, November fourth. He examined the death of a schoolgirl struck while crossing the road after leaving her school bus in December 2022.
- Caitlin attended Mount Lourdes Grammar School. The inquest found that she died from a traumatic brain injury caused by the collision. The reconstruction focused on the short interval between her emerging from behind the bus and the approaching car reaching her.
- Caitlin was visible for an estimated 1.2 to 2.7 seconds. McCrisken favoured the shorter end. The car was travelling at 45 miles an hour or less. The bus had stopped for about 12 seconds with its amber warning lights operating.
- McCrisken found no evidence of excessive speed. When the driver saw Caitlin, they veered left, partly onto the verge. The driver told a police officer, “She came behind the bus and I didn't see her, I'm sorry.” The car had no mechanical problems, and the driver hadn't suffered a medical emergency.
- The bus dropped Caitlin across the road from the entrance to her family home. The collision happened on the Moher Road in Kinawley, County Fermanagh. She tried to cross from behind the bus as a car approached on the other side.
- It was about half past four in the afternoon. McCrisken described dry conditions and diminishing light. The Education Authority's yellow school bus was making a familiar journey. Its driver remembered collecting Caitlin that morning, as he did five days a week.
- The bus driver said he saw Caitlin standing on the grass after she got off. Nobody was waiting for her, which he said wasn't unusual. He checked his mirrors and moved off. He explained that the doors wouldn't open with the handbrake off.
- McCrisken identified the bus's presence as a relevant feature of the collision. Its movement, position and engine noise may have affected Caitlin's awareness of the danger. That was a possible explanation considered at the inquest. The technical findings drew on evidence from forensic mechanical engineer Doctor Emerson Callender.
- People who stopped immediately tried to help Caitlin. They continued CPR until emergency services arrived. She was taken to the Royal Belfast Hospital for Sick Children with catastrophic head injuries. The court also heard statements from paramedics, police officers and medical consultants.
- The collision was on December sixth, 2022. Caitlin died two days later, on December eighth. The medical finding links her death directly to the brain injury she suffered when the car struck her.
- McCrisken concluded that the time available was insufficient for the driver to avoid impact, despite the attempt to steer away. The inquest's role was to explain the circumstances of Caitlin's death. Criminal responsibility and compensation claims are decided through separate legal proceedings.
- An inquest examines who died and how, when and where the death happened. A coroner records those essential facts without deciding criminal or civil liability. These findings explain the collision and the cause of Caitlin's death.
- Bob Hogg remembered a daughter whose smile lit up a room. He described Caitlin as full of wisdom, someone who took life in her stride and didn't take everything too seriously. She loved family outings and spending time with friends, and particularly enjoyed helping at her local Gaelic Athletic Association club.
- Her father told the court that her death had left a void that could never be filled. He said, “We think of her every moment of every day and she will never be forgotten.” He urged that no other family suffer their loss.
- The Hogg family has worked with other bereaved families to highlight risks to pedestrians and schoolchildren. McCrisken recognised that work as he concluded the inquest. He connected the circumstances of Caitlin's death with the wider discussion about children's safety.
- McCrisken stressed the vulnerability of children and pedestrians. His findings explain why this driver couldn't avoid the impact. Decisions about changing road-safety legislation sit with local politicians. The inquest's conclusions don't themselves change the rules protecting children on their way home.
