- Three gunshots killed a girl's dog while she was outside.
- Nicholas Cook faces a charge of knowingly killing an animal and has been released on bond. The grieving family still lives next door to him. Whether their dog, Briar, threatened his chickens sits at the heart of the case.
- The shooting happened October 22 on Wilson Station Road in Monroe County, Tennessee. Deputy Owen Hooper responded. Briar belonged to Sydni and Tyler Watkins, a Madisonville family. The sheriff's office says Cook shot her three times, killing her.
- Sydni says she and Tyler confronted Cook afterward. She acknowledged that both parents were distraught and yelling. She says his first explanation was that Briar had been outside near his chicken coop. When deputies questioned him, Cook said the dog had been chasing his chickens.
- Deputies say security video showed Briar licking a pan on Cook's property, away from the chicken coop. That challenges his explanation. But their description leaves open what Briar was doing throughout the encounter and whether the recording captured every relevant moment.
- Sydni also recalled Cook saying, “well I didn't know it was your dog”. That's her recollection of his words. Briar's presence on his land and any danger to his chickens are separate questions for the case. The charge leaves Cook's guilt for a court to decide.
- Briar followed Hadley Haynes everywhere, her mother said. Hadley called her “a really good dog” and “my best friend”. Sydni says the responding deputy came back a day later with a stuffed animal for her daughter.
- Sydni described Briar as “the sweetest and goofiest dog I've ever met”. Hadley was outside when the shooting happened. The loss now carries the family into two different legal paths: Cook's criminal prosecution and a possible civil claim for damages.
- Tennessee's law matching the charge prohibits knowingly and unlawfully killing another person's animal without the owner's consent. It grades that offense as theft, based on the animal's value. Cook's specific charging subsection hasn't been made clear.
- The civil law gives livestock protection a specific role. A person sued for killing a dog can offer proof that the dog had been killing or “worrying” livestock. The wording reaches earlier behavior as well as conduct during the shooting, and it goes beyond killing alone.
- That defense requires satisfactory proof. Cook's assertion about chasing chickens would have to be tested. The provision governs damages claims. Whether these chickens qualify as livestock, whether Briar's behavior meets that wording, and any criminal defense would require separate legal decisions.
- The Watkins family is considering a civil case. Tennessee also allows courts to award noneconomic damages, compensation for losses that don't come with a bill, when an unlawful intentional act or a negligent act causes a pet's death. The law puts a specific limit on that category.
- A court may award up to $5,000 in noneconomic damages under the pet-death provision. The family would have to qualify, and any award is discretionary. That figure limits this category of compensation. Other recovery and exclusions depend on the applicable law.
- For negligent acts, the law requires the fatal injury to occur on the owner's or caretaker's property, or under their control and supervision. The text attaches that condition specifically to negligence. It doesn't expressly impose the same condition on unlawful intentional acts. The family's eligibility still needs a legal decision.
- Cook was out on bond by October 26. His arraignment was described as scheduled for the following week, but the exact date isn't clear. The family is considering civil action. A court has yet to decide the criminal case.
- The Watkins family continues to live beside Cook. Sydni says seeing him every day is difficult. She described the change at home this way: “He took a lot of life out of our home when he took her away from us and it feels a whole lot emptier now. She was a good dog.”
