- Prosecutors dropped attempted-murder charges against a man whose girlfriend now faces a false-incrimination case.
- Justin Martin was arrested after Chelsea Villano accused him of setting her on fire during a camping trip. Ocean County prosecutors now say she fabricated that accusation, and they've charged her with two criminal counts.
- The question now is whether prosecutors can prove Villano falsely incriminated him.
- Villano suffered burns and smoke inhalation at a campsite in Plumsted Township, within New Jersey's Pine Barrens. Emergency crews intubated her and flew her by helicopter to Temple University Burn Center in Philadelphia. She received treatment and was released days later.
- Villano is 33 and lives in Eatontown. The emergency call on October 15 reported a woman burned and abandoned at a campsite. Prosecutors dispute her explanation of how she was injured and who was responsible. Her need for emergency treatment was real.
- Villano told detectives her boyfriend splashed her with alcohol, then tried to kill her and put her in a fire. Her account described a camping trip with another man and said Martin fled in a Chrysler 200. Prosecutors initially pursued that accusation.
- Martin, who is 36, was arrested on October 16 and charged with attempted murder and aggravated arson. Within three days, the prosecution itself asked a judge to let him out of custody. The charges stayed in place for four more days.
- Responders reached Villano on October 15. Martin was arrested October 16 and freed October 19, with charges still pending. Prosecutors dismissed those charges October 23 and charged Villano that day. She left jail October 28, with her own case pending.
- Recorded statements prompted the request to release Martin. On October 19, Assistant Ocean County Prosecutor Mara Brater told a Superior Court judge that prosecutors had learned something that undermined their case against him.
- Brater said the recorded statements indicated Martin “didn't have anything to do with the assault on her.” She asked for his release, and he was freed that night. Prosecutors later went further and dismissed both charges against him.
- The injuries also challenged Villano's account. Brater described information authorities had received about the pattern and severity of her burns. She said an intentional attack of the kind Villano described would have caused much more severe injuries.
- Brater said Villano's injuries were “more consistent with a blowback of fire.” That assessment gave prosecutors another reason to question the alleged attack. The precise way the fire began still hasn't been explained publicly.
- The two strands changed the prosecution's direction. Recorded statements undermined Martin's involvement, while the injury assessment challenged the attack Villano had described. By October 23, prosecutors had ended Martin's case and opened a criminal case against her.
- Martin's attempted-murder and aggravated-arson charges were dismissed. Villano faces two counts of falsely incriminating another person, based on prosecutors' allegation that she fabricated her accusation. She hasn't been convicted and is presumed innocent. Prosecutors still have to prove their case.
- Villano's charging date was October 23, 2026, the same day Martin's charges were dismissed. The public dismissal announcement followed on October 24. Martin had already spent time in custody before prosecutors sought his release.
- Villano was released from the Ocean County Jail on October 28, pending further court action. Her release allowed her to leave custody while the two false-incrimination counts remained pending.
