  1. A passing driver escaped injury after at least two shotgun blasts.
  2. Portland police say a man fired at the driver, and his own statements pointed to a racial motive. They've arrested Marc W. Schaffer and booked him on attempted murder and bias-crime allegations. What charges prosecutors will pursue, and what evidence they'll bring to court, is still unclear.
  3. Officers responded to someone seen carrying a gun on North Commercial Avenue on Saturday, October 31. Police put their response at 11:03 a.m., in the 6700 block, in Piedmont near North Rosa Parks Way.
  4. While North Precinct officers were on their way, dispatchers relayed more calls. People were now reporting that the suspect was firing shots. Officers moved toward him and ordered him to drop the shotgun.
  5. Police say the man dropped the shotgun when officers ordered him to. They took him into custody within seven minutes of the first unit being dispatched. Officers then recovered the shotgun and kept it as evidence.
  6. That seven-minute interval runs from dispatch to custody. The Enhanced Community Safety Team, which investigates shootings, then examined what happened before officers arrived.
  7. Investigators say Schaffer fired at least two shotgun shots at a passing driver. That gives a minimum shot count. Police say nobody was injured, including the person driving past.
  8. The attempted murder and attempted assault allegations concern what police say Schaffer tried to do. Police say their shooting teams treat gunfire aimed at community members as attempted murder cases. Prosecutors decide what charges to pursue in court.
  9. Investigators say Schaffer's own statements provided evidence that his actions were influenced by his perception of the driver's race. That's the basis police gave for the racial-bias allegation. They haven't disclosed his exact words.
  10. The allegation centers on the race Schaffer perceived. Oregon's bias-crime framework covers crimes targeting someone because of a perceived protected characteristic, including race. Investigators still have to substantiate the alleged motive as the case moves through the courts.
  11. Schaffer, a 52-year-old Portland resident, was booked into the Multnomah County Detention Center. Police listed four booking charges covering the alleged attempted killing, attempted assault, racial bias and property damage.
  12. The booking charges are second-degree attempted murder and first-degree attempted assault, along with first-degree bias crime and second-degree criminal mischief. Schaffer is presumed innocent unless proven guilty.
  13. We don't yet know which charges prosecutors will pursue or what evidence they'll present to support the alleged attempted killing and racial motive. Investigators were still seeking information from people who hadn't already spoken with police.
