“Final Battle”

其他播出的广告为“The Country He Loves”、“Celebrating the Enduring Spirit”和“To the Great Proud People of Iran”。

  1. On October 12, we reported a court-ordered ad shutdown. The ads kept airing.
  2. Taxpayer spending on five pro-Trump ads is now estimated at nearly 22 million dollars, including almost 10 million after his private-funding pledge. The unresolved stakes are whether the government fully complied, and whether taxpayers get any money back.
  3. Judge Jennifer Rochon ordered the administration to cancel the remaining challenged Homeland Security television placements, including Sunday evening's. Her October 11 order also froze the funding arrangements behind them. The broadcasts continued into Monday.
  4. The nearly 22 million dollars covers five ads since late September. Almost 10 million of that came after Trump's October 5 announcement. These are advertising estimates. The government still needs to reconcile them with contracts, invoices and payments.
  5. The new estimate replaces the 20 million dollars in the earlier broadcast. That broadcast's connection to a 175 million dollar immigration-enforcement package was wrong. The documented funding actions were a 20 million dollar allocation and a purchase order for the same amount.
  6. An earlier estimate put spending at roughly 12 million dollars. The later estimate raised it to nearly 22 million. Other earlier figures were 19 million and 20 million. Those figures use unreconciled cutoffs and accounting measures, so they can't be added together.
  7. Final Battle aired 193 times during local broadcasts of 60 Minutes. Maduro aired 198 times during America's Funniest Home Videos. Together, that's 391 Sunday-evening spots after the order took effect. Each count represents a broadcast in a local market.
  8. The order took effect Sunday at 6:45 p.m. Eastern. Those programs began around seven. Hundreds of market airings can come from two ad versions. Counting versions tells you how many different commercials ran; counting spots tells you how often they appeared.
  9. Monday's afternoon snapshot counted 20 more Maduro spots, 11 Final Battle spots and one for The Country He Loves. That's another 32. The two snapshots total 423 recorded airings, but the final, complete count still isn't known.
  10. The court emailed the order one minute after it took effect. Government lawyers forwarded it more than an hour later. The government says agency lawyers became aware Monday morning. Homeland Security then sent the order to its advertising vendor, LMD Agency.
  11. Assistant U.S. Attorney Jeffrey Oestericher apologized to the court and the plaintiffs. The government says it subsequently froze the purchase order and funding allocation. Its filing claimed compliance. Rochon still has to determine whether the government met every obligation.
  12. The plaintiffs requested a status conference about the continued broadcasts. They weren't seeking contempt sanctions at that point. A White House official said the last government-paid spots aired Sunday evening and outside groups would pay afterward. Nobody has identified who paid for each Monday airing.
  13. Rochon froze future payments under the purchase order, along with the associated 20 million dollar allocation. She also barred using or transferring Homeland Security funds for the challenged ads, and entering, renewing or expanding agreements to produce or distribute them.
  14. The restriction covers this challenged campaign. Ordinary government public-service advertising can continue, and the order doesn't prohibit privately funded political ads. Stopping further covered spending also leaves a separate financial problem: how much was already paid, and how much remains committed.
  15. The purchase order ran into September 2027, unless all deliverables and placements finished earlier. OMB allocated 20 million dollars on September 19, and Customs and Border Protection issued the order to Lepugh, which operates as LMD Agency, the next day.
  16. The administration argued its ad buys were ending October 11 and it had no plans for more. But Rochon found the longer contract and inadequate assurances against similar future spending still justified court intervention.
  17. Final Battle closely copied a 2024 Trump campaign commercial, apart from the funding disclaimer. Trump walked down a hallway promising to demolish the deep state and drive out the globalists. The disclaimer said, “Paid for by the U.S. Government.”
  18. Trump also promised to cast out communists, Marxists and fascists, throw off a political class he said hated the country, and rout the fake news media. The commercial supplied no information about Homeland Security's official functions.
  19. Maduro promoted the January U.S. capture of Nicolás Maduro. It showed Trump alongside Secretary of State Marco Rubio and Defense Secretary Pete Hegseth. Its message framed the operation as American power and a warning: “Don't play games with this president.”
  20. The other aired ads were The Country He Loves, Celebrating the Enduring Spirit, and To the Great Proud People of Iran. At least eight additional similar ads hadn't aired when the opinion described them. The spending estimate covers the five that had.
  21. By the morning of October 8, Final Battle had aired approximately 9,679 times. Its estimated cost exceeded 9.09 million dollars, with an estimated 972 million advertising exposures. One person can see an ad repeatedly, so exposures don't count unique viewers.
  22. Across all five ads, that earlier snapshot counted at least 16,254 airings, an estimated 1.56 billion exposures and about 15.4 million dollars. Those earlier campaign figures are already within the later spending estimate.
  23. The administration called the commercials public service announcements. Rochon's opinion said the defendants didn't contest that the ads were purely partisan and unrelated to Homeland Security's official functions. She found the challengers had a clear and substantial likelihood of winning their spending claims.
  24. Congress had authorized activities commemorating border-security efforts, including fallen-officer memorials, agency anniversaries and commendation ceremonies. Rochon found these ads exceeded the authorized purposes and implicated the ban on unauthorized publicity or propaganda. Her ruling is preliminary, with a final judgment still ahead.
  25. The spending laws require agencies to use appropriations for the purposes Congress approved. They also restrict unauthorized domestic propaganda. Rochon found the plaintiffs would suffer harm that couldn't be repaired later, and that the public interest favored temporary relief.
  26. Common Cause brought the challenge alongside Robert Hunter, SEIU Local 32BJ and its political action committee. Hunter is the Democratic nominee for Alabama House District 28. They sued Homeland Security, OMB and officials in the Executive Office of the President.
  27. A national survey found 86 percent of U.S. adults considered taxpayer-funded election-related ads featuring the president or cabinet members inappropriate. Among Republicans, it was 80 percent. That disapproval crosses party lines, but the court decides whether the spending was lawful.
  28. The survey ran from September 30 through October 5, using a probability sample of 4,506 adults through KnowledgePanel. At 95 percent confidence, the margin was 1.5 percentage points overall and 2.7 for Republicans. The ads aired ahead of the November 3 midterms.
  29. Trump promised to pay for the ads himself and with money raised for MAGA Inc., the super PAC supporting him. Taxpayer spending continued after that announcement. The White House then clarified that his promise applied to future funding.
  30. On October 6, a White House spokesperson said Trump's post “was not referring to reimbursement.” An administration official said payment would change “moving forward.” The administration's stated plan left prior public spending unpaid by Trump. Whether taxpayers recover money through litigation is still unresolved.
  31. The October 13 conference mentioned in the earlier broadcast had already been adjourned in Rochon's October 11 order. She said she'd reschedule it to discuss next steps. A replacement date hasn't been confirmed.
  32. The order lasts 14 days from October 11, subject to extension. That points to October 25 unless the court changes it. Rochon can extend or replace the restraint while deciding what follows for the lawsuit and the government's compliance.
  33. The cutoff didn't immediately stop every broadcast. The government says it later froze the funding arrangements and notified the vendor. A reconciled accounting still has to identify the affected payments and recoverable balances. No repayment to taxpayers has been confirmed.
