Trump et al., No. 26-3287 (TJK)

  1. On September 27 we reported restored press passes. Now five networks face an antitrust investigation. Their refusal to replace CNN disrupted shared television coverage of presidential events. The government is now demanding communications about that cooperation.
  2. Can the Justice Department prove that the networks’ response to CNN’s exclusion broke competition law?
  3. The White House blocked CNN from assignments its competitors usually share. Those competitors declined to step in. Their decision put a shared news service at the center of a conflict over access to the president.
  4. The Justice Department announced the investigation on October 10. A day earlier, it sent civil investigative demands, formal requests for information, seeking communications concerning the White House television pool. The department hasn't announced charges, enforcement action or a finding that the networks broke the law.
  5. ABC, CBS, CNN, NBC and Fox News are all under investigation. The department is examining whether their coordination violated the Sherman Act, a federal law against restraints on competition. The disputed conduct involves their shared television pool.
  6. The networks take turns covering White House events through that pool. When CNN's turn came and the administration denied it access, the other networks agreed not to take over. They made those decisions day to day.
  7. For several days in September, that left gaps in the shared camera coverage and footage. The interruption affected a service used to bring presidential events to multiple audiences. Other reporting about Trump could still continue through other means.
  8. The missing pooled coverage included an event involving Trump and Chinese President Xi Jinping. Its precise date hasn't been pinned down. A separate, dated exclusion involving Xi shows how reporters could regain credentials and still lose access to an event.
  9. The Justice Department says group boycotts among commercial competitors can violate the Sherman Act. Its theory turns on cooperation between businesses that compete for audiences. Proving a violation would require evidence about what these networks agreed to do and how that affected competition.
  10. The networks’ decisions also concern how journalists gather news when one newsroom is excluded. Their status as commercial competitors doesn't, by itself, settle whether this particular cooperation was unlawful. The dispute puts competition law alongside questions about constitutional protection for newsgathering.
  11. The department says its Antitrust Division is investigating to determine whether the networks violated antitrust law. That leaves the government's case at the evidence-gathering stage. Whether it can substantiate that case is still unresolved.
  12. Trump announced an immediately effective ban on CNN, MS NOW and Politico on September 18. The outlets sued. Judge Timothy Kelly heard their arguments on September 23, then signed an order temporarily restoring their hard passes on September 24.
  13. September 24 was the restoration date behind our September 27 report. The initial protection reportedly lasted 14 days and covered 78 passes. The relief was described as resting on due process, while leaving the First Amendment dispute for later in the case.
  14. CNN and MS NOW journalists were blocked from a September 24 evening event with Xi at the White House's North Portico, even after their credentials were restored. It's unclear whether that was the same Xi event that lacked pooled coverage.
  15. A hard pass permits entry to White House grounds. Admission to particular events and travel assignments can still be restricted. In our September 27 report, CNN's scheduled Air Force One slot had gone to Real America's Voice. Kelly's temporary order hadn't directly resolved those travel assignments.
  16. Bruce Brown, a press-freedom advocate associated with the Reporters Committee for Freedom of the Press, called the investigation intimidating. His concern centers on government scrutiny of newsrooms cooperating after the administration excluded one of them.
  17. A Cornell law scholar judged the networks’ conduct reasonable, subject to review. Those competing assessments frame the conflict. The department is pursuing a commercial-boycott theory, while critics question the use of federal investigative power against the networks’ response to an access ban.
  18. The administration opposed the outlets’ request for a preliminary injunction on October 2. The outlets made a further written effort to keep access, described on October 5. At an October 8 hearing, Kelly considered whether to block the ban for longer.
  19. The outlets have regained credentials under temporary court protection, and shared television coverage resumed. Access to every event and travel assignment remains unsettled. Meanwhile, the department still has to prove its competition-law theory; its investigation hasn't produced a finding of unlawful conduct.
  20. Access was reportedly extended until Tuesday, October 13. Kelly expected to decide by then whether to provide longer protection while the lawsuit continues. The Justice Department hasn't given a completion date for its separate investigation into the networks.
